These Terms of Use (“Terms”) govern your access to and use of the Legato Studio website. By using the website, you agree to these Terms to the extent permitted by applicable law.
Nothing in these Terms is intended to waive or limit a consumer, privacy or other statutory right that cannot lawfully be waived in your jurisdiction.
1. Acceptance and eligibility
You may use this website only in compliance with applicable law and these Terms. If you are using the website on behalf of another person or organization, you represent that you are authorized to do so.
A parent or legal guardian should submit inquiries on behalf of a minor when the minor cannot legally agree to the relevant terms or provide valid consent.
2. Website purpose
The website provides information about Legato Studio, music lessons, performances, media, studio activities and ways to contact or inquire about services. Website content is general information and does not itself create a lesson, performance or other service contract.
3. Inquiries, availability and bookings
Submitting a contact form, lesson request or event inquiry is a request for information only. A booking is not confirmed until Legato Studio expressly confirms availability and any applicable service details, price, schedule, cancellation terms, payment requirements and other booking conditions.
Separate written or communicated service terms may apply to lessons, performances, events or other paid services. If those specific terms conflict with these website Terms, the service-specific terms control for that service.
4. Public access and administrative systems
The public website does not currently require a visitor account. Any private administrative tools, management interfaces, APIs or update systems are not public services and may be protected by authentication, authorization and security controls. Unauthorized access or attempted access is prohibited.
5. Acceptable use
You agree not to misuse the website. Prohibited conduct includes attempting to:
- gain unauthorized access to accounts, administrative systems, APIs, servers, databases or restricted files;
- bypass authentication, rate limits, access controls or security measures;
- introduce malware, malicious code, automated abuse or destructive traffic;
- scrape, harvest or collect personal information in violation of applicable law;
- impersonate another person or submit false, fraudulent or misleading information;
- interfere with the availability, performance or security of the website;
- use the website for unlawful, infringing, abusive or harmful purposes.
We may restrict or block access reasonably believed to threaten the website, users or systems.
6. Intellectual property
Unless otherwise stated, website content associated with Legato Studio, including text, studio branding, page composition and original materials, is protected by applicable intellectual-property laws and may belong to Rachelle Moore · Legato Studio or the applicable rights holder.
Photographs, music, recordings, videos, third-party marks and other materials may be owned by their respective creators or licensors and remain subject to their rights.
The website's design and engineering credit identifies EXFORMA LABS / H@xx3L as the technical designer/developer. That credit does not transfer ownership of Legato Studio's client content, photographs, trademarks or other third-party materials to EXFORMA LABS.
You may view the website for personal, non-commercial purposes. You may not reproduce, republish, distribute, sell, exploit or create derivative works from protected material unless permitted by law or authorized by the applicable rights holder.
7. Information and materials you submit
You are responsible for ensuring that information you submit is accurate to the best of your knowledge and that you have the right to provide it.
Do not send content that is unlawful, infringing, malicious or unnecessarily sensitive. Submission of an inquiry gives Legato Studio permission to use the submitted information as reasonably necessary to respond to the inquiry and administer any resulting relationship, subject to the Privacy Policy and applicable law.
8. Third-party websites, media and services
The website may link to or display content from third-party services such as social networks, video platforms, payment providers, map services or other external websites. Third parties operate under their own terms and privacy practices.
A link or reference does not necessarily constitute endorsement. Legato Studio is not responsible for third-party content or services except to the extent responsibility cannot lawfully be excluded.
9. Website availability and changes
We may maintain, update, suspend, modify or discontinue website features at any time. We aim to keep information useful and accurate, but availability, schedules, pricing, biographies, service descriptions and other information may change.
We do not guarantee uninterrupted or error-free operation, and temporary downtime may occur for maintenance, security, hosting or circumstances beyond reasonable control.
10. Disclaimers
To the maximum extent permitted by applicable law, the website is provided on an “as available” basis for informational and communication purposes. We do not make guarantees that all website information will always be complete, current or free from technical error.
Nothing on this website constitutes legal, medical, financial or other regulated professional advice.
Any disclaimer in these Terms applies only to the extent permitted by law and does not exclude warranties, guarantees or remedies that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by applicable law, Legato Studio will not be liable for indirect, incidental, special or consequential loss arising solely from use of or inability to access the public website.
This limitation does not apply where liability cannot legally be excluded or limited, including any rights or remedies provided by mandatory consumer protection law. Service-specific liability, cancellation or refund terms may be addressed separately when a lesson, performance or other service is actually booked.
12. Responsibility for unlawful misuse
You are responsible for losses or claims directly caused by your unlawful, fraudulent or intentionally harmful misuse of the website, to the extent permitted by applicable law. This provision does not require a consumer to indemnify Legato Studio for Legato Studio's own negligence, misconduct or obligations that cannot legally be shifted.
13. Privacy and electronic communications
Personal information is handled as described in our Privacy Policy.
Newsletter and marketing communications include opt-out mechanisms where required. You may unsubscribe from marketing communications without preventing service-related communications that are reasonably necessary for an inquiry, booking or existing relationship.
14. Governing law and jurisdiction
Subject to mandatory laws that apply based on your residence, consumer status or the location of a transaction, these Terms and use of the website are governed by the laws of Alberta and the federal laws of Canada applicable there.
Any dispute that may lawfully be subject to a choice of forum will ordinarily be brought before a court of competent jurisdiction in Alberta, Canada. However, this clause does not deprive a consumer of a mandatory right to bring a claim or receive protection in another jurisdiction, including rights that may apply in Quebec, Ontario, elsewhere in Canada, the United States, the European Union or EEA.
15. Changes to these Terms
We may update these Terms to reflect changes in the website, services or applicable legal requirements. The date shown above identifies the current version. Material changes will be communicated in an appropriate manner where required by law.
Continued use after updated Terms take effect constitutes acceptance only to the extent that such acceptance is legally valid. Where affirmative consent is required, it will be requested separately.
